Medical Cannabis in New York

Program overview

New York operates the Medical Cannabis Program, administered by New York State Office of Cannabis Management.

How New York’s law developed

New York's Compassionate Care Act passed the legislature in 2014 after years of negotiation, and it launched as one of the most restrictive medical programs in the country: smoking was prohibited, only a handful of registered organisations could operate, and the qualifying condition list was narrow. Successive amendments loosened it considerably — chronic pain was added in 2017, and the 2021 Marijuana Regulation and Taxation Act broadened patient access substantially while creating the Office of Cannabis Management to oversee both medical and adult-use markets. New York permits certified patients to designate caregivers, and the state has periodically adjusted how many patients a single caregiver may serve. Home cultivation for medical patients was authorised by the 2021 law on a delayed timeline, making New York a state where the cultivation answer has genuinely changed within recent memory.
