Texas operates the Texas Compassionate Use Program (CUP), administered by Texas Department of Public Safety.
Texas does not have a conventional medical cannabis program, and describing it as one is misleading. The Texas Compassionate Use Act of 2015 created a narrow low-THC program administered by the Department of Public Safety, originally limited to patients with intractable epilepsy. House Bill 3703 in 2019 and House Bill 1535 in 2021 expanded the qualifying conditions to include additional neurological conditions, all cancers and PTSD, and raised the THC ceiling — but the program remains capped by potency rather than being an unrestricted medical market, and the number of licensed dispensing organisations is very small relative to the state's population. Texas has no designated-caregiver registration pathway comparable to those in most medical states, and no home cultivation of any kind is permitted. Physicians prescribe rather than recommend, which is a legal distinction with practical consequences.
