Medical Cannabis in Missouri

Program overview

Missouri operates the Medical Marijuana Program, administered by Missouri Department of Health and Senior Services.

How Missouri’s law developed

Missouri voters faced three competing cannabis measures on the same 2018 ballot, an unusual situation that shaped the program's structure. Amendment 2 prevailed, writing the medical program into the state constitution and setting a 4% retail tax directed toward veterans' services. Constitutional rather than statutory status matters in practice: the core patient protections cannot be narrowed by ordinary legislation. The Department of Health and Senior Services began issuing patient cards in 2019. Missouri is among the states that permit qualifying patients to cultivate at home after obtaining a separate cultivation authorisation, which is why home-grow questions dominate Missouri search traffic in a way they do not in states with no cultivation pathway. Amendment 3, passed in November 2022, legalised adult use while keeping the medical program and its lower cost structure intact.

Questions people in Missouri ask

Why is Missouri's program in the state constitution?
Amendment 2 in 2018 wrote the medical program into the Missouri constitution rather than into ordinary statute. In practice this means the core patient protections cannot be narrowed by a regular act of the legislature — an unusual level of durability compared with states whose programs were created by statute.
